LEGAL RULES of Drawing Weekend in Columbretes

The following are the legal conditions of the promotional action "Weekend Draw for two people in Columbretes " (hereinafter, the Action) carried out by Navega y Comparte, S.L., with CIF B40503377 and address at C/Alginet, 13, Benifaió (Valencia). The Draw will be governed by these legal bases (hereinafter the Rules).

The Rules of this promotional action are available to users at www.navegaycomparte.com

1. TEMPORAL SCOPE

The Action will be valid from the moment of the first publication until August 20th at 23:59h

If, for reasons of force majeure or beyond the control of Navega y Comparta, it is necessary to postpone or modify the duration of the Action, or to cancel or repeat it, this fact will be notified to the participants by the same means by which these Rules are published.

 

2. ACCEPTANCE OF THE RULES

Participation in this promotional action implies full acceptance of these rules and the express submission of the interpretative decisions made by the organizer. Navega Y Comparte reserves the right to disqualify participants who do not comply with these rules and, especially, any participation that goes against these rules.

By accepting these Rules, participants understand the terms and conditions of the Rules and agree to comply with any applicable regulations in this regard, so that by simply participating in the Sweepstakes they are consenting to be bound by the Rules and the law in a full and irrevocable manner. The participant's statement to the contrary, regardless of when it is made, will imply their self-exclusion from the Drawing and the release of Navega Y Comparte from any commitment made to the participant. These Rules are available on the Navega Y Comparte website www.navegaycomparte.com and will be available to anyone who wishes to consult them.

3. PARTICIPATORY MECHANISM

The deadline for participation in the draw is detailed in clause 1 of these legal bases. Within this period, users can participate both through the Facebook page and the Instagram page of Navega Y Comparte. To participate, they must:

The draw will take place among all the people who make the three steps before 23.59h of August 20th.

To complete step one, if you are already registered as a user of the website, it is sufficient to enter the website once with your email and password with the option to recover your password. You can take advantage of this to finish filling out your profile, since the more data you put in, the more chances you have of getting your travel companions right.

4. ELIGIBILITY REQUIREMENTS

Participation in the Promotional Action is limited to all eligible natural persons over the age of 18 who participate during the period of the Action.

Participation is voluntary and limited to those who meet all of the requirements listed below: Employees serving for or at Navega y comparte, or their family members in the first degree, are not eligible to participate.

This promotion and draw should not be used for

- Spread political or religious ideas.

- Promote insults and/or slander in front of third parties.

- Use violent, obscene or offensive language.

- Publish content that is different from the object of the game mechanics.

So comments not related to the draw will be deleted.

5. VERIFICATION OF REQUIREMENTS AND DECLARATION OF WINNERS

The draw will take place on August 22nd using a programmatic tool that will randomly select the winner from all comments registered on the Facebook post and the Instagram post that meet the requirements. There is only one trip winner for two people, so a draw will be made from each social network, and then another draw will be made between the winner of one network and another. The second one will remain as a substitute, in case the first one does not communicate the requested data in the established period or it is verified that he has not fulfilled step 1.

The digital managers of Navega Y Comparte will contact the winner by means of a direct message on social networks to request the email with which he has registered at www.navegaycomparte.com to check the step 1. The winner must communicate the email within 72 hours. In case of not answering or not fulfilling step 1, the substitute winner will be passed on.

If the alternate does not respond or has not completed step 1, the award will be declared void.

The winner will be announced in the digital profiles of Navega Y Comparte during the following 15 calendar days after the closing of the draw, in accordance with the data protection clause of these

6. PRIZE

The prize of the draw consists of a weekend on a sailing boat around the Columbretes Islands for two people. The trip includes transfer by sailboat on Friday afternoon/night from the port of Valencia, overnight stay on the sailboat anchored in the islands and return on Sunday afternoon to the same port in Valencia. Meals and drinks are not included.

Navega Y Comparte reserves the right to substitute any prize with another of similar characteristics.

The weekend will be enjoyed according to available dates and weather, during the months of September or October 2020, or when the current health situation allows it. Possible dates within these months will be considered so that the winner can choose the one that best suits him/her. If the winner does not choose any of the possible dates he/she will lose the right to the prize, although Navega y Comparga will do its best to enjoy it.

7. AMENDMENTS AND/OR ANNEXES

Navega Y Comparte reserves the right to make modifications or add annexes to these Rules in relation to its mechanics and prize, provided that they are justified or do not harm the participants, are made within the period of validity of the promotion, and are duly communicated to them.

8. PERSONAL DATA AND IMAGE RIGHTS

IMAGE RIGHTS: The winner authorises that the images and similar content obtained from the participant may be used for the dissemination of the prize awarded and in general for the dissemination of the Action via the Internet or other media, electronic or otherwise. In this sense, the participant assigns the patrimonial content of the right to his/her own image, without any temporal or spatial limitation, necessary to carry out the exploitation of the materials resulting from the Action and the secondary uses of the same, as well as their possible incorporation in other websites and written, graphic, sound or audiovisual works for commercial, promotional and merchandising purposes or any other Navigate & Share, being able to use any image captured from the participant.

PROTECTION OF PERSONAL DATA: The data collected will be processed by NAVEGA Y COMPARTE with code B40503377 and address in C/Alginet, 13 de Benifaió (Valencia.) with the main purpose of managing your participation in all phases of the Action "Weekend Draw for two people in Columbretes" including the processing of the delivery of the prize. Your data will be processed for this purpose based on both the maintenance of the contractual or pre-contractual relationship and the express consent given by you. You guarantee the veracity of the data provided, otherwise you may be disqualified from the Game.

Your data will not be transferred to third parties, except to authorities to whom Navega Y Comparte is obliged to send information.

You may revoke the consent given at any time, as well as exercise your rights of access, rectification, deletion, opposition, limitation to data processing, data portability, as well as not to be subject to automated decisions, by sending a letter to the above address or to the following e-mail address: info@navegaycomparte.com

The data provided and those collected during your participation in the Raffle / Promotion may be published on the website Navega Y Comparte, on social networks, or in any media in any medium, for promotion and/or dissemination purposes.

9. RESERVATIONS AND LIMITATIONS

Navega Y Comparte is exempt from any responsibility in the event of any error in the data provided by the participants themselves that would prevent their identification.

Navega Y Comparte reserves the right to declare the Sweepstakes void if neither the first winner nor the three alternates are eligible to participate in the Sweepstakes. In such case, Navega Y Comparte will notify the winners, without any right to make a claim.

Also, in case the development of the promotion is affected by circumstances beyond the control of Navega Y Comparte, or can not be carried out because of the present, foreseeable or supposed breach of any applicable law or regulation, Navega Y Comparte may cancel all or any part of the promotion without the participants being able to make any claim for it.

Navega Y Comparte reserves the right to remove any participant who tries to, or comes to defraud, alter or disable the proper functioning and normal and regulatory course of this Sweepstakes, as well as the resolution of any issue arising from this promotional activity. Navega Y Comparte excludes any liability for damages of any kind that may be due to the temporary lack of availability or continuity of operation of the services through which they participate to the fraud of the utility that users could have attributed to them, and in particular, but not exclusively, to failures in access to various pages and submission of responses to participation via the Internet, or telephone communications enabled for this purpose.

Navega Y Comparte reserves the right to make changes that will result in the successful completion of the promotion when there is a just cause or force majeure that prevents it from being carried out in the manner set out in these rules. Navega Y Comparte reserves the right to postpone or extend the period of the Sweepstakes, as well as the power to interpret these legal bases. Navega Y Comparte reserves the right to shorten, extend, modify or cancel this Contest, if exceptional circumstances prevent its realization, communicating these circumstances in a way that avoids any damage to the candidates in the Game. Navega Y Comparte will not be responsible for any delays, losses or damages for reasons not attributable to it.

Navega Y Comparte will also not be responsible for cases of force majeure that could prevent the winner from enjoying all or part of their prize. Likewise, Navega Y Comparte will be exempt of any responsibility if any of the indicated cases occur, as well as any responsibility for damages that could be caused during the enjoyment of the prize.

10. NULLITY

If any provision of these Rules were to be declared totally or partially null and void, such nullity or ineffectiveness would affect only that provision or part thereof that is null and void, with the rest of the Rules remaining in force and such provision or part thereof that is affected by not being included, unless, as it is essential to these Rules, it would affect them in their entirety.

11. JURISDICTION AND APPLICABLE LAW

These Rules shall be interpreted and governed in accordance with Spanish law. For any dispute arising from the existence, access, use or content of the Rules, the participant and Navega Y Comparte expressly waive any other jurisdiction that may correspond, submitting to the jurisdiction and exclusive competence of the Courts of Valencia.
