Navega y comparte is a platform that offers a wide range of sailing plans that aims to make the sea more accessible to all people, putting in contact people who want to sail and enjoy the sea.
There are two types of users:

Ideal for corporate skippers, who do not have their own website or invest in advertising and it is more profitable for them to pay a small commission for bookings. The company skippers offer services to crew members with or without experience (the booking of the boats).
It is about sharing the experience of sailing, sharing the expenses of the journey, such as gasoline, food, ports during the crossing, regatta registration fees and boat rental
. It is not an economic activity because it is an outing with friends, so as a skipper, you collaborate with the expenses as one more.
There can be no economic benefit.

It can be made with or without pattern.
Ideal for crew members who want to enjoy the sea, without any knowledge of sailing: vacations, special sunsets, celebrations, etc.
When you are done, you can click save, if you want to add something later, or click save and publish.
You can access your profile at any time by clicking on the top right-hand side (where your photo and nickname appear) to access your management panel, where you can consult the outings you have published, edit them and consult the bookings that other users have made for your outings.
Once a trip has been published you can add as many trips as you want, without having to re-post everything.
If you want to add departures, but first you want to change something, you have the option to duplicate trip. When you duplicate a trip, all the data is duplicated except the departure dates and price, so that you can add the new ones you want. When you duplicate a trip, it is important that you change the title, because the title that is automatically created is "copy from ......".
If you want to modify a published trip, you must first of all unpublish it. This can be done as long as it does not have reservations, as a trip with reservations cannot be edited or modified.
If you want to modify a journey with reservations, you have two options
- Set free places to zero, duplicate trip and thus edit the duplicated trip, adding new departures.
- Send an email to administracion@navegaycomparte.com and indicate what you want to modify. If it does not affect important conditions of the trip, the modification will be made by the administration.
It is advisable to check the user bookings frequently, in case you need to approve bookings without prepayment, zero cost or cost sharing. To do this, you can first check the crew member's profile to approve or reject the booking.
You will also be able to update your profile, check if you have made any reservations with other employers and check the private messages sent to you by other users.
If you have started to publish a trip but you have been left halfway through because you were interrupted by something or because you couldn't find any data, don't worry, we will send you an e-mail reminder of uncompleted trips, so that you can do it quietly when you have time.
If the skipper considers that a crew member does not fit the published profile or that his or her behaviour is not appropriate, he or she may decide not to let them board his or her boat before sailing.
The page is based on trust, if the profiles do not fit the reality, the employer has the right of non-admission, and it is good that he publishes an opinion in the corresponding profile so that it does not happen to other employers.
Even if the behaviour during the trip is not suitable (someone who does not want to comply with the safety rules at sea, someone who gets violent, etc) it can leave the crew member whose behaviour is not suitable in the nearest port, the skipper and the sailor not being responsible for the return trip of this crew member. In these cases it is also very important to publish an opinion in the crew member's profile, so that it does not happen to other skippers. The crewmember has the obligation to follow the indications and rules of behavior of the skipper, especially regarding safety. The skipper is the only authority on board.
The employer for safety reasons has the authority to modify the initial plan. The sea and wind conditions are not completely predictable, so both the skipper and the crew must adapt to the conditions of the moment. Therefore, these are not strict itineraries, but can be modified according to the conditions of the moment. Moreover, by unanimity of the skipper and crew, any itinerary can be modified during the trip. However, in any case the skipper has the last word and the authority to decide.
The skipper can ask the crew members for the ID card on the day of the excursion or a few days before. The crewmembers have the obligation to show the ID card when the skipper requires it.
Similarly, the crew members can ask the skipper, if they deem it appropriate, for their ID card, as well as ask to examine the documentation of the boat, insurance and the sailing certificate. The skipper has the obligation to show this documentation to the crew member who requires it.
In the case of full boat rental with skipper or without skipper, a boat rental contract will be signed between the boat owner and the responsible crew member, which cannot contain any clause that goes against the general conditions of this platform. Should this be the case, said clause will be considered null and void, prevailing the general rules accepted by both parties when publishing a trip or making a reservation. This contract must be signed on the boat on the day of the excursion or trip, so that it can be shown if any authority requires it. In the case of rental without a skipper, the responsible crew member who signs the contract assumes that he or she has the necessary qualifications to pilot the rented boat.
All users, both skippers and crew members, consent to the public expression of opinions by other users, so that the information published may be useful to other users. It is important that the opinions are as objective as possible, and that they alert future users to non-compliance. At the same time it is important to highlight good qualities, if they are attentive, helpful, fun, know a lot about surfing, have skills to highlight, etc.
Navigate and share is not responsible for the opinions expressed by its users, but those who express them are responsible. Although, in case some of them could contain offenses or expressions of defamatory character, the affected user will be able to contact with Navega y Comparta, who will value to eliminate the comment in question. Always bearing in mind that a negative evaluation is not offensive for the simple fact of not being positive, but only when it contains injurious expressions or of defamatory character.
As a patron you accept that you own the uploaded images and that they are not copyrighted

These rules are intended to minimise problems and confrontations, although we are aware that there will be some. And in spaces as small as boats, coexistence may not be easy if all users do not do their part.
Non-compliance with the platform's rules may result in a temporary or permanent suspension of the user profile.
The prices in company mode are final prices, and they have to specify exactly what they include.
Prices are set by the employer, and payments are made as the employer decides when publishing the trip.
If the crew member breaks something during the trip, he is obliged to compensate the owner for the cost of the repair or restitution.
Sailing and Sharing charges NO COMMISSION to the crew for reservations. It only charges the skipper in some cases.

At any time through the platform you can make inquiries about the excursions through a messaging system enabled for this purpose. From the administration or the employer will resolve the doubt as soon as possible.
For a better organization the skipper is advised to make a WhatsApp group among all the participants of the excursion with the name of the sailor and share more the date of departure.
We can only guarantee payments and compensation for cancellations, of the collections managed by us.
We cannot guarantee advance payments outside the platform, so we advise you not to make advance payments to your employer, even if you ask for private
Cash payments on the day of the excursion are allowed.
A crew member can cancel his place by accessing his profile. At that time the place will be released and can be reserved by another user.
If a crew member cancels a reservation in rental mode, he or she must compensate the owner, because while the reservation has been in force, a place has been occupied that may not be occupied by another person. In addition, he will have to assume a small fee for the cancellation costs:
If a crew member makes too many cancellations or does not show up on the day of the excursion he or she may be terminated by the administration for misuse of the site.
If the skipper cancels for safety reasons due to the weather, it can either be agreed to carry out the activity on another day, or the full amount of the price paid in the reservation can be refunded.
If the skipper cancels for personal reasons, the crew member will receive the total amount of the reservation, and the skipper will have to pay and share 10% (VAT included) of the amount to be returned to the crew members with a minimum of 10 euros (VAT included) for management costs.
It is not usual for the skipper organizing the excursion to cancel, but if he does so and there is no justified force majeure, he may be fined or suspended from his profile.
In any case, the crew member will receive the total amount of the reservation, and the skipper must also pay and share 10% (VAT included) of the amount to be returned to the crew members with a minimum of 10 euros (VAT included) for management costs.
To cancel a reservation, the skipper must send an email to the crew member with a copy to cancelaciones@navegaycomparte.com
The crew member has a period of 5 calendar days from the date of theoretical completion of the activity or trip to inform Navigate and share the failure or any incident that has occurred in the contracted route. Once this period has expired without any kind of claim from the crew member, Navega y Comparta will consider that the journey has been carried out satisfactorily.
Each skipper is responsible for his boat, having valid documentation of the boat, the insurance and the title to be able to sail it.
The employer is free to publish any feature of the type of trip he wants to take, as long as it is legal. He is solely responsible for what is published, for the organization of the trip and for the compliance with legality throughout the process
By publishing a trip, the skipper expressly accepts everything contained in the rules of use of the platform.
The commission charged by Sailing and sharing with the skipper on prepaid trips is 8%+VAT of the total amount of the reservation, minimum 8 euros plus VAT
Reservations without advance payment because they are paid directly to the skipper, because they are zero cost or because they are shared expenses do not accrue any commission.
It is advisable for the employer to check whether the level of experience published in the profiles corresponds to reality, and to comment on it so that the information is useful for other employers. This is especially important for new profiles. If a crew member says he knows a lot and in practice this is not true, it can be dangerous for everyone.
An advantage that the skipper has in rental mode is that through the platform he can meet his future clients, publishing short trips if he has a professional degree or participating in trips in friend mode with other skippers if he does not have one. We are sure that meeting in advance crew members with recreational qualifications interested in renting a boat, will give more peace of mind when it comes to renting the boat itself.
In Spain the skipper in rental mode must meet the following requirements:
Sailing and Sharing will not systematically inspect or check that skippers are complying with the regulations in force. Each skipper is responsible for complying with the regulations in force in his home country or country of operation and Navega y Comparga assumes no responsibility in the event that this is not the case. But Navega y Comparta does reserve the right to ask for justification of prices and activities if it perceives that some regulation is not being complied with. If the skipper refuses to justify or change what is suggested by Navega y Comparga, he could be cancelled as a user, without having Navega y Comparga any kind of responsibility.
Thus the skipper accepts that he is solely responsible for complying with the current regulations of what he has published on the trips, for having the boat's documentation in order and having the appropriate titles for sailing and that the photos published by him are not copyrighted.
When a skipper publishes an available free place, he is responsible for providing the service described, under the published conditions, so it is advisable to publish fewer places than are available or to be very careful to reduce the places available in the event of having reservations by other means. If a skipper does not comply with the published service, he will have to assume responsibilities, such as if a crew member claims a flight to the place of departure of the excursion in case it is not made, and pay in any case the cancellation fee of 10% of the amount of the reservation (VAT included)
After 5 calendar days from the date of completion of the excursion or trip, and provided that no crew member has complained about the failure of the same or any incident, payment will be made to the skipper between day 6 and day 12 of the amount of the reservations less the commissions corresponding to the account number indicated in the private profile.
Advertising of any company is not allowed in any part of the website.

It is only allowed for private skippers who have rented a boat through the platform or a company of the group and limited to twice a year.

In the same way the crew members can ask the skipper, if they deem it appropriate, for their DNI, as well as ask to examine the documentation of the boat, the insurance and the navigation license. The skipper is obliged to show this documentation to the crew member who requires it.
All users, both skippers and crew members consent that other users give their opinions publicly about each other, so that the information published can be useful for other users. It is important that the opinions are as objective as possible, and that they alert future users about non-compliances. At the same time it is important to highlight good qualities, if they are very attentive, helpful, funny, who know a lot about navigation, who have skills to highlight, etc.
Navega y comparte is not responsible for the opinions expressed by its users, but are responsible for those who issue them. However, in the event that some of them may contain offenses or defamatory expressions, the affected user may contact Navega y comparte, who will consider deleting the comment in question. Always bearing in mind that a negative review is not offensive for the simple fact of not being positive, but only when it contains libelous or defamatory expressions.
The friend mode is usually for experienced people, but if you have no idea of navigation, it is better to make it clear from the beginning, since the maneuvers in navigation require practice, which if you do not have it could be unsafe both for yourself and for the rest of the crew.

The advertised contribution to the crossing costs is the only amount a crew member is obliged to pay, since a crew member has to know the cost of the crossing before making a reservation in order to decide whether to make it or not.
However, the employer has the option to return the exact cost of the trip or to ask for an extra amount. The crewmember has the right not to pay more than the agreed amount, if he does not see it justified.
The aim is to share costs, and sometimes a priori it is difficult to predict exactly. It is a question of being a little flexible and both skippers and crew members try to adapt as much as possible.
In addition, the crew member must bear in mind that what he pays for sailing in friend mode is much less than what he would pay in charter mode, so if the skipper says that he has fallen short in calculating the costs he should be sympathetic and even if he has no obligation, he should agree to the payment proposed. You will surely get a good comment from your employer
Examples of expenses that could justify a higher payment in friend mode:
A trip in friend mode is not a service, and the crew member when making a reservation expressly accepts it. There is no contractual relationship between user and skipper, nor between users. Both the skipper and the crew must collaborate in the tasks of managing the boat, cooking and cleaning, and even the initial purchase of food can be done by a crew member different from the skipper. If you have any skill that can contribute to make the trip more pleasant, I'm sure the rest of the crew will appreciate it. If you have any skills that can help the skipper in the conservation and maintenance of his boat, he will surely want to sail more times with you. It's all about creating a community of sailors with the common hobby of wanting to enjoy the sea.
The amounts of the contributions are set by the employer.

In this case the crew member will receive the full amount of the price paid in the reservation.

In friendly mode a skipper cannot charge more than the expenses strictly for the trip such as gasoline, food, overnight stays in port outside the home port, regatta registration fees, boat rental, etc.
It is therefore advisable to keep invoices (not tickets) in the name of the skipper for these expenses (port bills, petrol and supermarket bills on dates just before the trip or during the days of the trip, regatta entries, boat rental bills, etc.), in case you have to justify to the tax authorities or some other authority that the trips made are sharing expenses and that it is not an economic activity.
The skipper, at the moment of publishing a trip, can choose if he wants us to charge the crew member 50% or 100 % on line or if he prefers to charge directly on the day of the excursion. Choosing to pay in advance by credit card is important for trips with high amounts, to ensure compensation in case of early cancellation or no show of the crew on the day of the excursion.
